Privacy Policy – MOVI SOS APP

Movisafe América Latina (“we”, “us”, “our”) operates the MOVI SOS mobile application (hereinafter referred to as the “Service”). This Privacy Policy explains how we collect, use, store, and protect your personal data when you use the Service, as well as your rights and options regarding this data.

By using the Service, you agree to the collection and use of information as described in this policy. Our goal is to protect your privacy and comply with applicable laws, including Brazil’s General Data Protection Law (LGPD).

  • Service: The MOVI SOS mobile application operated by Movisafe América Latina.

  • Personal Data: Information that identifies or enables identification of an individual, such as name, email, or phone number.

  • Usage Data: Information automatically collected during use of the Service, such as IP address or device type.

  • Cookies: Small files stored on your device to enhance the Service’s functionality.

Types of Data Collected

Personal Data
When you use the Service, we may request:

  • Email address

  • First and last name

  • Phone number

  • Two emergency contact numbers

Purpose: To identify you, contact you in case of emergency, and provide 24/7 assistance.
Legal Basis: Contract performance (Art. 7, V, LGPD) and consent (Art. 7, I, LGPD) for emergency contacts.

Usage Data
Automatically collected:

  • Mobile device type, unique ID, IP address, operating system, browser, and diagnostic data

  • Real-time location when the panic button is activated, enabling tracking for assistance

Purpose: To ensure Service operation, monitor usage, and detect technical issues.
Legal Basis: Legitimate interest (Art. 7, IX, LGPD) for safety and functionality.

Cookies and Tracking Technologies
We use cookies and similar technologies (pixels, tags, scripts) for:

  • Session Cookies: To enable the Service

  • Preference Cookies: To remember your settings

  • Security Cookies: To protect against threats

Purpose: To improve user experience and ensure Service security.
Legal Basis: Consent (Art. 7, I, LGPD), except for essential cookies (legitimate interest, Art. 7, IX, LGPD).

You can manage non-essential cookies through the consent banner in the app. Disabling them may affect functionality.

Purposes of Data Use

We use collected data to:

  • Provide and maintain the Service, including 24/7 assistance

  • Notify you about Service changes

  • Offer interactive features

  • Provide customer support

  • Analyze and improve the Service

  • Detect, prevent, and resolve technical issues

  • Comply with legal obligations

Data Retention

  • Personal Data: Stored as long as necessary for stated purposes or as legally required (e.g., 5 years for assistance records, per applicable laws).

  • Usage Data: Retained for up to 1 year for analysis, unless otherwise required by law.

After the retention period, data is deleted or anonymized unless needed for legal compliance.

Data Transfers

Your data, including Personal Data, may be transferred to servers in Brazil or other countries with adequate data protection laws. We ensure safeguards, such as standard contractual clauses, to protect your data, in accordance with Art. 33 of the LGPD.

If you are located outside Brazil and provide us with data, it will be processed in Brazil. By accepting this policy, you consent to this transfer.

Data Disclosure

We may disclose your Personal Data when necessary to:

  • Fulfill legal obligations (e.g., court orders)

  • Protect the rights or property of Movisafe América Latina

  • Prevent or investigate misuse of the Service

  • Ensure the safety of users or the public

  • Protect against legal liabilities

Data Security

We implement technical and organizational measures to protect your data, including encryption and access controls. However, no transmission or storage method is 100% secure. In the event of a security incident, we will notify you and Brazil’s National Data Protection Authority (ANPD) within 72 hours, as required by Art. 48 of the LGPD.

Service Providers

We engage third-party providers (“Service Providers”) to support the Service, such as server hosts or data analysts. They have limited access to your data solely for performing their tasks and are required to protect it per this policy and the LGPD.

Children’s Privacy

The Service is not intended for children under 13. We do not knowingly collect data from children without verified parental consent. If we become aware of such collection, we will delete the data immediately. If you are a parent or guardian and believe your child provided data, please contact us.

Data Subject Rights

Under LGPD (Art. 18), you have the following rights:

  • Confirmation and Access: Verify whether we process your data and access it

  • Correction: Update incomplete or incorrect data

  • Deletion: Request deletion of unnecessary or improperly processed data

  • Portability: Receive your data in a structured format

  • Objection: Object to certain data processing

  • Withdrawal of Consent: Revoke consent at any time

Emergency Contact Data

By providing emergency contact numbers, you confirm that you have obtained consent from those individuals. This data is used solely for emergency assistance and protected with the same safeguards as your personal data.

Changes to This Policy

We may update this Privacy Policy periodically. We will notify you via email, in the app, or on our website before changes take effect. The updated policy will be posted on this page with a new effective date. We recommend reviewing it regularly.
